Welcome to the Copyright Protection page of NyasIP. As a creator, your original works are your most valuable assets. Protecting them from unauthorized use and infringement is paramount to preserving your rights and ensuring fair compensation for your creativity.
What is Copyright Protection?
Copyright protection grants creators exclusive rights to their original works, including literary, artistic, musical, and other creative expressions. These rights enable creators to control how their works are used, reproduced, distributed, performed, and displayed. Remember, copyright protection fosters creativity, sustains industries, and enriches our global cultural tapestry.
Why should copyright be protected?
Copyright is a crucial legal concept that safeguards intellectual property rights. Here are key reasons why it needs protection:
- Incentivizing Creativity: Copyright encourages creators (authors, artists, musicians, etc.) by granting them exclusive rights to their work. This motivates innovation and artistic expression.
- Economic Value: Copyrighted works generate revenue through licensing, sales, and royalties. Protecting copyright ensures creators can benefit financially from their creations.
- Preserving Cultural Heritage: Copyright preserves cultural diversity by safeguarding traditional knowledge, folklore, and indigenous expressions.
- Balancing Public Access: Copyright strikes a balance between creators’ rights and public access. It allows limited use (fair use) for educational, research, and transformative purposes.
Works protected under Copyright:
Section 13 of Copyright Act, 1957 protects all original:
- Literary works: Books, novels, stories, computer program codes etc.
- Musical works: Music, choruses etc.
- Artistic works: Paintings, photographs,cartoons (Mickey Mouse, Tom and Jerry), drawings etc.
- Dramatic works: Dance steps, screenplays, operas etc.
- Cinematograph films: Movies, video films etc.
- Sound recordings: Any recording of sounds, recording of songs by sound recorders etc.
Who is an author?
As per section 2(d) of the Copyright Act, 1957 “author” means, —
- in relation to a literary or dramatic work, the author of the work;
- in relation to a musical work, the composer;
- in relation to an artistic work other than a photograph, the artist;
- in relation to a photograph, the person taking the photograph;
- in relation to a cinematograph film or sound recording, the producer; and
- in relation to any literary, dramatic, musical or artistic work which is computer-generated, the person who causes the work to be created.
Why Copyright Protection Matters:
- Legal Protection: Copyright protection safeguards your creative works from unauthorized use by others. It establishes your ownership rights and provides a legal framework for pursuing legal action against infringers.
- Monetary Benefits: By securing copyright protection, you can monetize your works through licensing, distribution, and sales. Copyrighted works can generate revenue through royalties, licensing fees, and other commercial opportunities.
- Preservation of Integrity: Copyright protection allows you to maintain control over how your works are presented and used. It protects the integrity and reputation of your creative output by preventing unauthorized alterations or misattributions.
